These terms cover the website and related services worldwide. Delivery services are provided by Amp Wellbeing and shipped by specified courier service or Royal Mail.

The website and related services (including any applications which allow you to buy our products from us on mobile devices) are made available to you in accordance with the following Terms of Use & Service, and any other rules posted on our websites (“Terms”). Please read the Terms carefully before placing any orders, we recommend you should keep a copy of the Terms for future reference.

These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Amp Fitness Ltd, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

You may, for your own personal, non-commercial use only, do the following; retrieve, display and view the Content on a computer screen. but such use is limited and does not include the right to:

We may change, withdraw, or suspend access to the website (in whole or in part and permanently or temporarily) with or without notice and with no liability to you.

The website may include links to other websites or resources. We have no control over the content of these websites and are not liable in any way for their content.

Any material that you upload to the website or which you send to us via any other medium (including all social media) will be considered non-confidential, non-proprietary and we will have the right to use, copy, distribute and disclose to third parties such material for any purpose. We also have the right to disclose your identity to any third party who claims that such material infringes their intellectual property rights or their right to privacy..

We will not be responsible or liable to you or any third party for the content or accuracy of any materials posted by you or any other user of the website and you agree to be responsible to us for and indemnity us and keep us indemnified against all costs, damages, expenses, losses and liabilities incurred and/or suffered by us as a result of any claim in respect of your use of the website. We have the right to remove any material or posting you make on the website at our sole discretion.

 Whilst Amp Fitness Ltd uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

PURCHASES

Please read all these terms and conditions. As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with.

These Terms and Conditions will apply to the purchase of the goods by you (the Customer or you). These are the terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions. By ordering any of the Services, you agree to be bound by these Terms and Conditions. You can only purchase the Goods from the Website if you are eligible to enter into a contract and are at least 18 years old.

The description of the Goods is as set out in the Website or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of the Goods supplied. We can make changes to the Goods which are necessary to comply with any applicable law or safety  requirement. We will notify you of these changes.

All orders are subject to our acceptance and availability. Items that are placed in your shopping basket are not reserved and may be purchased by other customers. We may choose not to accept your order in our discretion for any reason without liability to you. Examples of occasions we may not accept your order are: that we are unable to obtain authorisation for payment; shipping restrictions apply to a particular item; the item ordered is out of stock, the item ordered does not satisfy our quality control standards and is withdrawn; or that you do not meet the eligibility criteria set out within the Terms.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

After submitting an order to us, we will send you an order acknowledgment email. This email will include your order number, details of the Products you have ordered from us and delivery details. Please note that this email is an acknowledgement of your order and is not an acceptance of your order.

Acceptance of your order and formation of a contract of sale takes place when your order has been dispatched and we have sent you an email confirming this.

When placing an order for the first time, you may be required to or may be offered the option to register with us and complete certain required fields on an order form. Where we ask you to provide and use identifiers and passwords to access restricted parts of the website, it is on condition that you shall be responsible for ensuring that such identifiers and passwords are kept secure and confidential at all times. You shall comply with all security directions and/or recommendations given by us and inform us immediately if you become aware or suspect any unauthorized use of your account.

You will only be charged for products once they have been dispatched for delivery.

We will store a record of your transactions for a minimum of one year.

We will use a selection of methods as appropriate to the goods to send parcels in the UK, and a selection of methods for international shipping. Please note that Amp Wellbeing does not accept responsibility for additional duties and taxes that are incurred when shipping outside of the United Kingdom. 

The price of the Goods and any additional delivery or other charges is that set out on the Website at the date of the Order or such other price as we may agree in writing.

Prices and charges include VAT at the rate applicable at the time of the Order.

You must pay by submitting your credit or debit card details with your Order and we can take payment immediately or otherwise before delivery of the Goods.

 

RETURNS

If you are not totally satisfied with your purchase, subject  to these Terms and Conditions, you can cancel this contract for whatever reason within 14 days from date of receipt and in perfect original saleable condition with the original packaging. We will try our best to ensure your return is processed as quickly as possible but please note this may take around 5-8 working days from receipt of your parcel. Return postage is to be covered by the customer and we do recommend using a trackable returns service.

To exercise the right to cancel, you must inform us of your decision to cancel this Contract by a clear statement setting out your decision by email to  hello@ampwellbeing.co.uk listing your name, order number, the product you wish to return and the reason for that return. You do not need to wait for a reply before returning.

Then please post your goods back to us within 14 days including your name and order number and reason for return inside the package.

If approved, your refund (if the goods are returned in the original packaging in unused, perfect condition) will be processed and a credit will automatically be applied to your credit card or original method of payment. Please allow a week from receipt of parcel before the refund is completed.

We may make a deduction from the reimbursement for loss in value of any Goods supplied, if the loss is the result of unnecessary handling by you (ie handling the Goods beyond what is necessary to establish the nature, characteristics and functioning of the Goods: eg it goes beyond the sort of handling that might be reasonably allowed in a shop). This is because you are liable for that loss and, if that deduction is not made, you must pay us the amount of that loss.

All such rights are reserved.

By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights Your use of the website and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to its content including our Software and all HTML and other code contained in this Site without the owner's prior written permission.

The AMP trade mark and all other marks, trade names, service marks, brand names, business names, illustrations, logos, prints which appear on the products on the website or their packaging, whether registered or unregistered are ours and are protected by applicable trade mark laws around the world. All rights are reserved.

All other intellectual property in or connected to the website, our products, or any related packaging, stationery, marketing material, or in any other way are either ours or licensed to us and such rights are protected by the applicable laws around the world.

 

LIMITATION OF LIABILITY

Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

We will not be liable to you in respect of any losses arising out of events beyond our reasonable control. To the maximum extent permitted by law, Amp Fitness Ltd accepts no liability for any of the following:

a. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill orcommercial opportunities;

b. loss or corruption of any data, database or software;

c. any special, indirect or consequential loss or damage.

By placing an order you agree and understand that we may store and process your personal data in accordance with our Privacy Policy. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
